More Late Breaking News **UPDATED**

I'm suddenly hearing from multiple sources that the Texas Rangers have begun an investigation into the Harris County District Attorney's Office and have begun interviewing people.

4:35 p.m. - Channel 13 is now reporting that the Texas Rangers and the Federal bureau of Investigation are interviewing people at the Harris County District Attorney's Office.  Click here for more info and tune into Ted Oberg at 5:00 p.m. to catch his report.

I am envisioning the Harris County Criminal Justice Center lying on its side in Buffalo Bayou, half covered with water. Judges, juries, prosecutors and others are jumping out windows swimming for their lives, and demanding to know "where the hell is the captain, DA Pat Lykos?"

Her ship is sinking, whether she realizes it or not. The TX Rangers and the FBI boys would be wise to watch the airports and the cruise terminals.

Don - Patsy wanted me to ask you to run a google search on Walker & Trivette. There are several others you will also need to check out so Jim will call you on Saturday and give you their names ...expect to do searches on several FBI agents, more Rangers and at least two judges and their spouses. Please do a non investigation/cursorary search - oops I mean look for political connections to anyone in Houston that doesn't sit on the sixth floor - on further thought I'm sure they are violating many laws so why don't you run a criminal search too! I expect some pictures of these criminals also.

This sounds like there is more going on than has been reported. The FBI looks at corruption issues that violate Federal Statutes. The Rangers investigate Violations of the Texas Penal Code. It would be reasonable to assume they are looking at multiple issues rather than just one.

This will be a drawn out affair and I predict more folks than Rachel will be exercising their 5th Amendment rights.

When she walked into that called press conference last week with her three stooges behind her, and began her verbal attack on the Grand Jury, it was clear she thought she had skated her bad behavior. Not looking that way now.

Not totally correct, Anon 5:35. There is a broad federal law called Obstruction of Justice that could give the FBI jurisdiction as the the facts as alleged.

Of course, the real danger in a federal investigation is making a false statement to the agent. It's like perjury without being under oath.

In any event, it's like a double bad news day when the FBI and the Rangers come'a callin'.

Any predictions on who takes the fifth this time?

The Rangers couldn't find a corrupt politician if you tuned them loose in Washington. As much as Austin hates Houston/Harris County, they don't meddle in Houston problems unless they can pass another law.

The Bureau will find someone guilty, only it means they can get a promotion and transfer out of Houston. The Feds only look into Harris County if they can get some media mileage out of it.

I have been out of the loop for awhile,, having grown up in Harris County and practiced law there for many years before moving to another jurisdiction.

It seems to me that a number of the things Pat Lycos has initiated have been very beneficial to criminal defense lawyers.

You are too probably young to remember having to hand write the notes from the State's file, wasting time and desperately looking for a copying machine to cheat time and perhaps not being able to read our own writing. Yes, some of us in the old days may have done the unthinkable and actually copy the o/r rather than hand write it out.(Is this action criminal, or just bad judgment)?

Now at very least this new idea of allowing discovery freely saves many lawyers time and effort,, at very most it allows defense attorneys efficient discovery of the state's file. (Unlike Holmes, Rosenthal, et. al.).

Anyway,, I'm not saying Pat is correct in getting nervous and perhaps looking into those who are looking into her,, but I'm just saying,, if the roles were reversed,, I suspect I'm not the only one who would react perhaps as she did,, (if in fact she did anything illegal at all).

It may come as a surprise to some of your readers,, but perhaps a new DA may not be the most efficient DA for our clients and may revert to tactics utilized by Holmes, Rosenthal, et al.

When Pat was a Judge,, I always found Pat to do things that were not popular with a lot of attorneys or for that fact,, even DA's,, but I remember one thing that Pat did. Pat gave us defense attorneys an option to prison and allowed some of my clients to get help for their addiction when other Judges didn't. I know several of my former clients who actually appreciated that.

I'm not saying Pat is perfect, above the law or anything like that,, I'm just saying her office policies have made my job easier and given my clients other options to these terrible crimes such as DWI.

I'm wondering if the "new old" guard will allow options to what is now an income raising opportunity for the State and a terrible financial burden to most of my clients.

Maybe, just maybe,, as an ex-prosecutor, (I never was one),, the old system might be better,, then again,, you might be another "meddling outsider" who changed teams and is not to be trusted by the "new guard". Perhaps your hand writing should be be exemplary,, cause you might just need it.

Anyway,, it's just something to think about.

All I'm saying,, is beware of the "new, old guard",, it may not be as much fun as you think. Then again,, it might be.

Something to think about,, along with the presumption of innocence.

@Rage, there are several to pick from. Rifi Newaz and Mark Donnelly come to mind first.

PL believes that she is above the law. Ordering the grand jury transcripts, ordering people to report back to her when they received a grand jury subpoena, high ranking ADA's monitoring who went in to testify in the 185th, ordering an investigation into who was on the 185th grand jury and how they were related to any other political figures, and where they live, etc. and while those investigating are at it, let's try and add Former Judges Mike and Devon Anderson and Judges Susan and Marc Brown. I pray that PL is exposed for what she is.... A politician who will stop at nothing to get what she wants... To be re-elected.

How is this not ten times worse that what Chuck Rosenthal did to be asked to step down? We all keep asking that question and then Lykos goes and steps in it again and looks worse than she did before, more unethical and vindictive, and yet she stays. The FBI and the Texas Rangers were never investigating Rosenthal. Woodfill, how can you possibly think Lykos has brought transparency and is good for Harris County?

NEWS FROM THE BUNKER:

Item: Six now regretting many things. Leadership team falling apart. Many want to leave.

Item: Show and Tell resumed after the first of the year. Evaluations did not. At today's meeting we were warned of HPD officers secretly taping us at intake show they could show Andersonians how uncooperative we are with law enforcement. (Really this was said)

Item: Special Procecutor for the contempt proceeding is Chris Tritico. An out of county judge has been assigned. Look for that to heat up soon.

Item: Speaking of those transcripts that ADA's got after they were kicked out of the grand jury, apparently the Feds want to know about that too.

Item: 232nd grand jury very uhappy. We hear they do not have enough to indict on their investigation and they want to open a new one but cant.

Item: We hear that Vollman really did suggest indicting Fertitta

Item: The Leader came to the investigator meeting last week. Her stay at the meeting barely exceeded the time for a Don Hooper sex act, 85 seconds.

Item: Six very unhappy about the short lived Hooper blog.

Item: People at the office are talking about the fact that Bridgwater was represented by Zimmerman and Levine for his 185th grand jury appearance and paid them out of his campaign account. As the grand jury investigation was not campaign related this seems like an issue to many of us.

Item: It is true that Lykos sent a team to channel 13 to complain of the coverage. This was done with county employees on county time. They even tape recorded the meeting.

Item: We hear that six tapes all encounters with the media. An open records request has been filed for those tapes.

End of line.

I am a current ADA. I hate you. All of the ADAs I work with hate you.

You force people like Mark Donnelly and Rifi Newaz out (both now working for different offices of the United States Attorney), while giving de facto promotions to Rachel Palmer, who has brought more discgrace on this office than anyone in recent or historical memory.

You replaced highlly skilled and experienced prosecutors like Craig Goodhart and Luci Davidson (with extensive experience) with political hacks like Hannah Chow and Lana Shadwick (neither has ever tried a case).

You are a fraud. People outside of the DA's office are starting to see this.

So Barnhill says they will cooperate "fully" with any FBI/Rangers investigation into the DA/DA's office. If my memory serves me correctly, it was the PL's position that they cooperated fully with the 185th's investigation as well. A prosecutor asserting her 5th Amendment right is cooperating fully? I wonder how many of the "Leadership Team" (notice how I put that in quotes?) will cooperate fully with this FBI/Rangers investigation, and by that I mean invoke their right to remain silent? While it is well with in their rights to do so, as criminal justice PUBLIC servants we are held to a higher standard, not a double standard. If you don't like the higher standard required of the position you can get out at anytime.

One thing you point to is offense reports when you talk about Lykos being good for the office. That's about all she can claim too. Kelly Siegler, whom I think many would call old school, wanted to give defense attorneys offense reports as well. I haven't heard that Anderson wants to change that.

I think giving defense attorneys a copy actually protects the state too. Just because they have a copy doesn't mean that they read it. Plus it saves lots of discovery issues around trial. "The state didn't tell me that.". Response from ADA, "Judge, it's in the offense report, page three.". Bottom line is that some of the rest of stuff you mention, an option other than prison.... That's certainly more feel good than Republican. Divert program, it's illegal. If it wasn't, don't you think the legislature would allow DADJ for DWI's? Also, Do the Write Thing, nice feel good program... But te DA's office actually pay people to do that? And there aren't enough prosecutors or investigators? Renaming the divisions... It's all in the packaging and advertising. Listening to Lykos say that because of the Cold Case Division, or whatever she calls it, she got 900 or something cases looked it and tried to find. Did she mention that many of those cases were either dismissed or poured out in a motion for new trial? Or did she mention that some the state won't be able to do anything because a cop is serving federal time? All things that should have been looked into beforehand.

You want legal programs that may help offenders who need help and will respond to treatment.... Try drug court, mental health court, and veterans court. Don't look to Lykos for help with that.

You can thank Lykos and her crew for running of a lot of talented people. The rest are hunkering down... Waiting for News from the Bunker, and for Ted Oberg's next story.

One of my favorite barristers and a close personal friend, the late Judge Marvin Teague of the Texas Court of Criminal Appeals, once wrote in a dissenting opinion "Color me not only amazed, but do it in chartreuse." [King v. State, 687 S.W.2d 762, 767 (Tex. Crim. App. 1985)]. Hopefully Marvin will not be offended if I adopt that observation when commenting upon the recent glowing endorsement of Lykos for her magnanimous "offense report" policy and her former outstanding judicial abilities. I am somewhat puzzled that if this cheerleader has left this jurisdiction why it still writes in such a manner as if it still practices here. That aside, Lykos, in my opinion and I suspect the opinion of 99 and 44/100% of the lawyers who actually practiced in her court, and her staff was that she was a poorly rated judge - she was discourteous, was a "Peter Principle Poster Child", and was narcisstic. At least she has been consistent, however, and carried those traits to her current position. Apparently, though, as of today, she has added one more negative trait to her repertoire.

Like any Organization in the private sector, in the public world of the Criminal Justice System there should be a division of labor and strict boundaries. The following comment made in the Chronicle article is extremely disturbing: "We were simply trying to learn if there was a political motivation behind the attacks," Lykos said." What attacks? Comments on THIS BLOG? Or the
G.J. going "rogue on you" and requesting a Special prosecutor and or NOT wanting ANY current Lykos staff inside the G.J.?

You see here is the rub. Curiosity kills the cat. You had no legal authority to INVESTIGATE and you know what you ordered was just THAT Period! If you had faith in your office and wern't such a control freak, you would have done nothing.

Then later like DID occur, play by the rules with lawyers representing every side in Court. –

BOUNDARIES! YOU don’t get to peek in situations like this – just like normal citizens don’t.
Ms. D.A. what in the law gives you the right to investigate the Grand Jury AFTER they have been seated and names sealed, as well as your future political opponent based on YOUR perception of POLITICAL motivation and not PROBABLE CAUSE to honestly believe a crime was being committed by using County resources?

Hasn’t anyone learned from Watergate – You appear in person when you think it benefits you, then you only give unsworn paper statements when the facts do NOT serve you? Kind of like a prosecutor taking the 5th. Kind of being coy and hiding the truth from the PUBLIC because you forget YOU are a mere public SERVANT! SERVANT! SERVANT! Madam! Contrary to campaign promises you are NOT being TRANSPARENT – (hollow words now).

Where in the law does it state a Grand Jury has to inform YOU if and when they are investigating YOU Ms. Lykos? They don't. Ever seen the look on a client target's face when one of your investigators serves them with a G.J. Subpoena at their home in front of their family? Or they go into their bank and get funny looks because the bank has been busy collecting copies of years of bank records?

You overstepped your sworn duties as the elected District Attorney and engaged in the crime of Abuse of Official Information, (Not a mere cursory review of the internet) and Misuse of public property by a public servant.
The same Criminal Justice System that indicts Joe Citizen every day, and the same one in which one of your assistants took the 5th, when you and every assistant are to be held to a higher standard, demands that YOU now truly be investigated for your actions mentioned here.

As one notable prosecutor used to argue: If this investigation of your office does NOT happen, then instead of a “Justice System”…we only have – “Just-A-System”!

A Special grand Jury should be impaneled immediately and what they do in investigating you Ms. Lykos is none of your damn business! They are Grand...YOU are NOT! You are a Public Servant! And as such, your bosses, the PUBLIC deserve a formal “look see” into whether or not a crime was committed by their employee!

Mike Anderson has said he will continue to give offense reports to defense attorneys. Since that is the only good thing Lykos has done, there is now not a single reason to keep her. Her one good action will be continued under Anderson and all her bad policies will be discontinued.

I would assume that our good ole Texas Rangers will be providing a balanced investigation that addresseses the timing of the GJ investigation and its sickening amount of ties to the Anderson's. Last time I checked, there is this little GJ form that says one will not participate in any cases that one has interest in. I'm sure the TR and FBI are reading. Don't forget that one, guys, in your fair and unbaised investigation of the Harris County Criminal Corruption Tower. I am, quite frankly, getting sick of both sides - the Harris County GOP sickens me, and Texas as a whole, is a tarnish on the national party.

Wow. KHOU finally has the story, but they have couched it in frighteningly pro-Lykos terms. No mention of her investigation into the grand jury at all. They imply that the Rangers and the FBI are just interviewing a single disgruntled employee, and that they've joined the conspiracy. At one point, they actually say, "This does not seem to rise to the point of an investigation at this point," based on the standard 'cannot-confirm-or-deny' language used by the FBI.

Shameful.

Talk about stalking. Lycos had people with guns and badges following grand jurors. That had to intimidate some of them and influence their decision not to indict.

The Fertitta family, Zack especially, have done nothing wrong at all. They are a cornerstone of this community.

What you have is the DA Leadership Team using the institution as a tool to further their own personal agendas; at the detriment of the citizens of this great county.

It just so happens, Ms.Vollman is pushing for an investigation to taint Fertitta. This is based on her own shortcomings and jealousy. She could be described as a Mini-Patsy; Venomous and self-serving.

If Patsy loses, Vollman's past deeds will come home to roost.

Now why don't any posters on this blog send a letter to veiwpoints. I realize that some of you can't for fear of retaliation. However, you do have friends that might consider writing one for you.

The more info the public has the better able they will be to make an informed decision when voting.

Yes, and Judge McSpadden knows Chuck Norris, who used to play Walker, Texas Ranger, so we can add those two to the conspiracy as well.

Also, Chuck Norris recently endorsed Newt Gingrich, which would explain the Federal involvement.

Random thoughts:

Joshua Ben Bullard-are you the same guy who has filed so much frivolous paperwork and appeals in family court because you did not get your way. Not much credibility there.

Can you get your retirement check in a federal prison?

The Don McWilliams I have known for 25 years would have recognized the instructions from Lykos were at a minimum not police connected and at a maximum illegal.

Just checked BJ where truth matters not and it still matters not. No post about the FBI and the Rangers. I guess he figures his/Lykos' republican followers don't need to know about that.

Started to make a list of all the defense attorneys hired by the leadership team and associates. As long as they are paying them and not from campaign funds, it helps the economy but it is getting long.

BREAKING NEWS - Death penaly lawyers for Carl Wayne Buntion, accused cop killer, who gunned down HPD Officer James Irby, have filed an appeal seeking "to have Pat Lykos removed."

Not that it will come to anything, but the thought that Lykos actions have caused these kind of ripple effects in criminal trials is disturbing.

She needs to step down

The PL positive blogs (or blog - only one - Big Jolly) are saying this is "all political" and the FBI and Rangers are just following-up on a routine complaint.

So - my question - how many times *EVER* has the FBI and/or Rangers investigated the Harris County DA's Office? Or, any DA's Office?

It would seem that if this is "political" that lots of folks would use this as a method of making candidates look bad.

I have asked some old-timers, but no one can remember ever seeing something like this.

Is it just me, or is this kind of a "big deal" that they have opened an inquiry, or an investigation, or whatever you want to call it?

Yikes - QX makes a really good point - he said it doesn't matter if it was a "google" search only - it was an abuse of power because only SHE had the names of the grand jurors. Joe Defendant would NOT.

Anon 922pm; I think that Big Jolly's post is a prime example of Murray's theory that Jolly is Lykos' new blog..... Makes sense here. No comment on how it's unprecedented for the DA's office to be looked into by the Feds. Because guess what, I highly doubt the Feds have the time or the interest to look into a complaint by a disgruntled employee, unless the target confesses on TV that she ordered an investigation.... Yeah, I think that there is something to look into then. Jolly had to get that out for the blue hairs to read so they can still be delusional and support Lykos. Has anyone checked if he is on the payroll? It's funny how the shift in Jolly's blog really came after Benzion was hired at the DA's office. Before that time, Jolly did a fairly balanced piece on Mike Anderson and his candidacy and his passion. (I wish people that hadn't been prosecutors could understand the passion the we dedicate to our job.... Real prosecutors that is.). And I won't digress into how many people work for Lykos's DA's office that don't do prosecutor work, that have been hired with high paying salaries, because that's a whole other post. Though, I would point out that it seems her latest hire, Benzion, has gotten her good publicity....as I have certainly not noted anything that he has done since he has been hired, other than follow Palmer to her latest hearings.

Jolly can also say that I am a disgruntled employee.... Blah blah. That's an easy answer for him when confronted with the facts that there are ADA's that don't like Lykos. Can everyone just get over that the reason why REAL ADA's don't like Lykos isn't because of politics, or her defeating Kelly Siegler.... It's because we can't do our job. Rules come out because she doesn't want to look bad in the press. Well guess what, sometimes justice means making decisions that are not favorable to the public or the press. Lykos will not support those decisions. Lykos hires lots of people that don't seem to give any help to the troops on the ground.... You know, the ones in the trenches.... YOU KNOW THE ONES PROSECUTING CASES, or providing immediate support to those prosecuting. Jolly and Hooper also say we are whining and should just accept our fate with Lykos at the helm. We are whining because we want to get back to doing our jobs, justice. Doing the right thing. Politics be damned! She doesn't know how to do that. We stay because we want to help the victims. We want to help the cops also trying to do justice.


I just hope that my colleagues and I can weather this storm. As Oberg points out, it's affecting a very important a case ( and could affect others)..... A man who killed a police officer definitely deserves a death sentence a second time..... But even if a jury decides he does not, the decision is serious enough to be free from the politics of Lykos and her ethical issues.

Thanks for responding. I went to law school with Zack and happen to know several members of his family. I couldn't wrap my brain around the MERE POSSIBILITY that he or one of his family members could have remotely done something below board.

I wholeheartedly agree, Zack IS good people. The bs needs to stop.

Gary Polland is in survival mode. He needs Pat Lykos more than she needs him. Any other DA would investigate the justice being served in the Juvenile Courts and controversy in this race keeps prying eyes away.
